General Counsel

The Creative Commons General Counsel advises on and implements the legal programs of Creative Commons and provides general legal advice and assistance to Creative Commons (CC). The General Counsel reports to the CEO.

Specific responsibilities include

* Managing and completing legal programs for Creative Commons
* Conducting legal research and preparing written memos, articles or other explanations for the CEO, Board, and/or general public
* Reviewing, drafting and negotiating all manner of contracts including grant agreements, NDAs, general service contracts and other contract documentation
* Identifying, advising on and managing legal risk that arises in relation to program and activities
* Preparing internal policies and procedures and ensuring compliance
* Liaising with potential license adopters, licensees, stakeholders and other interest groups about the Creative Commons licenses and related issues
* Managing all complaints, disputes and litigation, including investigation and risk assessment
* Overseeing the use of outside counsel to ensure effectiveness and cost efficiency
* Reviewing international and regional policy documents and consultations and developing the organizational position and response
* Preparing "human-readable" explanations of CC licenses, programs and activities for the general public
* Presenting to a diversity of audiences and industry
* Performance of other related duties at the direction of the CEO

Qualifications

* J.D. or equivalent law degree
* Admitted to practice
* Demonstrated experience in and passion for intellectual property and technology law with a particular focus on copyright law
* Familiarity with related areas of law (including trademark, patents, privacy, contract)
* Excellent drafting, analytic, communication and interpersonal skills
* Based in or willing and able to move to San Francisco, CA, USA.

Pluses

* Exposure to and awareness of open content licensing such as Creative Commons or free and open source software
